Legal systems across the world sometimes distinguish acts of sanity from acts of insanity. Legal systems across the world sometimes distinguish the mentally ill from the mentally healthy. Legal systems across the world sometimes distinguish the cognitively competent for the cognitively incompetent. Legal systems across the world sometimes distinguish approved acts of murder from criminal acts of murder. Legal systems across the world all create lists of crimes and their associated punishments.
Humans are complex incompletely programmed organisms that come in 7 billion varieties. Our programming is a work in progress – a colony of code from our genetics, life experience and our conscious, subconscious and physio-sensory functions. We operate across vast spectrums of nuance and exchange.
Instead of applying impossibly tiny checkboxes to define the life and future of a human being within the context of society, we can make sane, mentally healthy, cognitively competent decisions based upon knowledge, systemic understandings, Nurture, Equality and a recognition of our own fallibility.
We start with objectives. Prevention of harm. Protection from harm. Elimination of harm.
We balance the NETS of an individual- with all life and systems inextricably linked to the individual.
If a person is a threat to him or herself, we should supply the best available support to prevent and protect. Starting before birth.
If a person is a threat to those around him or her based upon a proven act of uncontrolled violence, no matter what the contributing variables were with the exception of last resort self defense (drugs, alcohol, gangs, drugs, youth, hate, genetics, mental process, provocation, hormones), we should supply the best available support to the person and the best available protection for anything vulnerable to that harm. Starting before birth.
And we should set aside the current insanity of prisons and courts and check boxes and start over. We should focus on the living. Make life worth living. Sustainable. Survivable. Precious. Joyful. Supportive. Collaborative. Knowledge Seeking. Passionate. Objective driven NETS. Starting before birth.
If a person harms another person, our commons interest is to protect the commons from future harm. Systemically and organically, the commons interest is to preserve personal freedoms and enable all parties to achieve their potential. Belief in the checkbox for sane or insane, competent or incompetent, mentally ill or mentally healthy is misguided. We are each on our own unique continuum of conscious, subconscious and corporal function. Distinguishing between treatment for some and punishment for others, between additional procedural protections for some and limited procedural support for others, between long prison sentences for some and short sentences for others, is an artificial construct driven by the simplicity of the check box. As we now know, the bail mechanisms of criminal justice have become severe and unnecessary barriers to freedom and justice for people with low incomes who cannot make bail, leaving them incarcerated without due process despite their often low risk to the commons of violence or flight. The right to a speedy trial and the right to not be incarcerated until found guilty and the right to a fair and truth based hearing by impartial judges and juries is no longer standard practice across America. Sentencing is radically skewed, unconnected to objectives or reality. Civil and criminal trials become a battle of finances, with the winner often determined by who can persevere despite excessive costs. Public prosecutors and attorney generals have become compromised by political relationships and commercial corruptions. The Supreme Courts is more about political ideology than principles and justice and defining objectives. What a hurtful hot mess.
Everyone should receive support in the form of real live caring human beings based upon their individual context and needs. But waiting until a person is so deeply and irrevocably programmed for harm or despair or chronic street crimes or massive white collar thefts or depression or chemical dependency or cognitive shutdown, so damaged that their route to a mutually nurturing existence is doubtful, is insane.
We can imagine a vast array of self-sustainable systemic frameworks that offer alternatives to the inherited realities of limited education, limited jobs, limited early childhood nurture, limited nutrition, prisons, high crime, high fear, low hope, low help, high cost. If we use the little check box for insane vs sane, we, the commons, would sometimes be judged insane to spend more money to imprison a person, regulate a person, police a person, adjudicate a person, fear a person, and deny a person the opportunity to generate value for the commons instead of starting before birth to invest a similar amount of resources to nurture every person so they are loved, educated, liberated, empowered, and supported by small fabrics of caring people possessing enough resources so that everyone can realize their potential.
If we use the little check box for mentally ill vs mentally healthy, we, the commons, would sometimes be judged mentally ill to believe hate and anger and violence of all kinds are normal healthy emotions and behaviors, occupying many of us – day to day – life to life. We, the commons, would sometimes be judged mentally ill to believe that products and practices that cause direct catastrophic harm, that are pervasive and hawked on every corner, can be accepted as part of everyday normality. Suicidally, knowingly, consuming poisons, destroying essential environments, and performing death defying feats leading to an early death automatically causes the mentally ill box to be checked in some legal systems.
If we use the little checkbox for mentally competent vs incompetent, we the commons, would sometimes be judged clearly incompetent if we ignore the fact that the systems we have created to manage our world do not have clear NETS based objectives, transparent measurement and feedback loops, and visual proof processes that connect objectives with decisions, with actions, with achievements and with the systemic balance of protections that deny the tyrannies of power and greed and corruption and weapons access to our potential.
